Planning & Zoning Meeting
August 11, 2009
Chair Loewen opened the Planning meeting at 7:05 p.m. He called
for any changes or additions to the minutes. With none Supervisor
Wicker/Chuck Froehling made a motion to approve the minutes as presented.
Motion carried.
Old Business: None
New Business: Clerk Harff questioned whether she should be billing Knife
River for the gravel pit out by Tom Sommers property. The board felt
if they are hauling out of there, they should be getting a permit. The
discussion was that $30.00 was not enough and should be reviewed.
Suggestions were to charge by the size of the pits, the larger pits would
pay more. Pits discussed were Jody Machereth, Krippner Excavation, Mid
MN, Knife River, and Kimball Rod & Gun Club. Chair Loewen will
check into it further.
Angie Berg, Stearns Co Environmental Services came before the board to
discuss the communication gap between the county and township. The
township is issuing building permits before site permits are issued from the
county. Ron Albers, Bldg inspector for the township, was
assuming the site permit was issued at the time the plat was approved.
Angie explained that not all platted land has building entitlements.
The county does a lot of land searches before they issue a site permit.
Angie explained the township could do all their own permitting but they
would have to make sure all the proper procedure is met with water
infiltration, septic, wetland, etc. She also explained that any major
alteration of a building is required to come before the county because they
might need to update their septic system. The county site permits cost
$200, septic permits $200, Address fee $25 and other costs are Impact
wetland permit, and a state permit for excavation over an acre.
Supervisor Loewen asked about a call he received concerning playground
equipment on Pearl Lake. A complaint came in that new playground
equipment was put in to block the view of the neighbors. Berg will
email the clerk as to the requirements.
Supervisor Loewen asked about the existing law concerning farming within 50
feet of a wetland, shoreland, or creek. Angie explained that DNR
developed the rules and passed it to the county for enforcement. Berg
explained the ordinance is in the book but just not enforced. It has
been discussed at the county level how they are going to enforce the
ordinance.
Supervisor Unterberger was concerned the county is going to be reviewing a
permit for a RV Park on Goodner Lake. Unterberger wanted to know why
the township doesn’t have a right to have input in the matter. Berg
explained the township can attend the hearing but according to the
ordinances, the Schindele’s would be allowed to have one recreational
vehicle per parcel of land, a tent counts as one unit.
Schindele’s are requesting 4 campers, 1 fish house, and 1 port a potty.
Septic and water will be required to be up to date and all road and lake
setbacks will need to be met before any conditional use permit will be
issued.

Supervisors Loewen/Wicker made a motion to adjourn the Planning & Zoning
meeting. Motion carried.
